I, (customer requesting service) agree to the following terms and conditions for rental of described services.

THERE WILL BE AN ADDITIONAL $200 FEE FOR DEBRIS THAT IS OVER THE SIDE RAILS OF THE DUMPSTER.

Pricing & Payments:

 

1.   Customer agrees to pay $349 for one 10 yard container, $399 for one 15 yard container, and $450 for one 20 yard container (base fees). The purchase includes 1 drop off and 1 pickup. This includes up to 2 tons for 10 yard dumpster, 2.5 for 15 yard dumpster, and 3 tons for 20 yard dumpster, 4 tons for 30 yard dumpster, 5 tons for 40 yard dumpster as well as any overages included due to overloading or additional days requested by the customer. Due to strict weight limitations and associated dump fees, any additional materials will be billed at $50.00 per ton above our accepted tonnage for the dumpster.

a.) In no event will customer load 10 yard container with debris weighing 12,000 lbs or more.

​

b.) In no event will customer load 15 yard container with debris weighing 12,000 lbs or more.

​

c.) In no event will customer load 20 yard container with debris weighing 12,000 lbs or more.

​

d.) In no event will customer load 30 yard container with debris weighing 20,000 lbs or more.

​

e.) In no event will customer load 40 yard container with debris weighing 20,000 lbs or more.

​

2.    Customer is responsible for any additional fees assessed by the landfill for certain items such as tires, appliances etc.

​

3.    The container rental includes use for up to 7 days. If the container is kept longer than 7 days there will be an additional fee of $15.00 a day.

​

4.    Payment for all base fees as well as any known additional rental time will be due before delivery of the container. Any additional fees due to overweight or other fees not paid upon delivery are due within 24 hours of container pick up.

​

5.    Any unpaid balance after 24 hours from pick up date will start to accrue $15.00 per day late fee from the date of container pick up until paid in full.

​

6.    If paying by check and the check is returned for insufficient funds from the banking institution the customer is responsible for any returned check fees at a minimum of $65.00.

​

7.    Any refunds will be less than the original processing fee that we are charged.

​

8.    The landfill bills our company every 30 days. If you exceed the weight limit, we may not be notified for several weeks. If applicable, there will be a delay in charging/billing for excess weight fees. The card, email and address associated with the order will be charged at that time.

​

9.    Wait Time: If a driver must wait for customer to move vehicles, remove material from an overloaded dumpster/container, clear an area for delivery, remove material placed in front of a unit, wait for a customer to unlock a gate or any other reason that causes a driver to wait, the customer will be charged a $2.00 per minute service fee. Furthermore, if there is no attempt to reschedule or communicate the issue with the company, the customer will be charged for additional rental time at the rate of $75 per day plus dry run fee.

9.)    If customer address is outside 20 mile radius of service, they will be charged at a $5/mile rate for distance traveled beyond the 20 mile service area.

10.   There will be a 3% fee for payments via credit cards.

 

Dumpster Use:

1.    While the dumpster is in your possession, you will NOT place or allow to be placed into the dumpster:

​

• Substances that are hazardous to health such as toxic or corrosive materials or liquids.

​

• Liquids of any kind whether contained or not.

​

• Cans, drums, or other containers of any kind unless emptied and crushed and incapable of carrying any liquid.

• Medical waste or animal carcasses of any kind.

​

•  Any material not listed above however considered unsuitable for containment e.g. malodorous waste; asbestos, paint, tires, gas bottle, fluorescent tubes, light bulbs, vehicle batteries, and bulky electric appliances such as but not limited to older televisions and computers.​​

a.) Customer warrants and represents that the dumpster will not contain any hazardous materials and acknowledges that the disposal of such hazardous materials is strictly prohibited. For purposes of this Agreement, “hazardous materials shall mean any waste which is listed, has the characteristics of, or is otherwise identified as hazardous waste or subject waste under applicable state or federal laws or regulations, including but not limited to the Resource Conservation and Recovery Act of 1976 (42 U.S.C. et seq. and the regulations promulgated thereunder). “Unacceptable material” shall mean any non-hazardous waste which is not permitted to be processed at a facility under applicable laws or permits, source, special nuclear or byproduct material as defined by the Atomic Energy Act of 1954 and the regulations thereunder; asbestos-containing waste; mercury-containing waste; and any waste delivered by Customer which is not approved by Company. If Customer has any questions about whether a particular material is considered hazardous, please call the Company before disposing of the material in the dumpster.

b.) In the event that contents that are not allowed by this contract or any Federal, State, or City agency are disposed of, all costs, fines, penalties, or other actions taken for said disposal, the customer is fully responsible for any and all associated charges. Costs may include but not be limited to cleanup, monitoring, legal fees, penalties, or any other charges associated with unauthorized material disposal. Materials may be returned to the customer at the customer’s expense.

2.    All refuse shall remain within the confines of the dumpster and shall not exceed the top or sides. Every attempt shall be taken to equally disperse the weight of the refuse within the dumpster.

​

3.    Customer shall be liable for any loss or damage to rented equipment in excess of reasonable wear and tear.

​

4.    Customer shall not relocate dumpster or move with a machine due to damages this may cause if you need to relocate call us and will relocate at a fee of $149.00.

​

5.    HaHa Dumpsters does not allow dumpsters on site for more than 30 days with no activity. Therefore, if the dumpster has not been swapped or removed within 30 days, we will have to remove, swap or recharge the full rate for the dumpster unless other arrangements have been made.

​

Access and Ground Conditions:

 

1.    The customer will be responsible for the provision of free and suitable access to and from the delivery site (including the removal and reinstatement of local obstructions) and for ensuring suitable ground conditions for delivery, placement, and removal of the dumpster. No responsibility will be accepted for the damage to any surface, and you should therefore take any steps to protect surfaces (e.g. paving slabs, soft ground) before delivery.

2.    HaHa Dumpsters will not be held reliable if the heavy container or truck causes damage to concrete or asphalt and yard or driveway.

3.    Should the customer fail to return the container, HaHa Dumpsters maintains the right to enter upon the premises where the container may be without notice and take possession of and remove it at the customer’s expense all without legal process. The customer is hereby waving any claims for damages from any such entry or removal.

​

4.    Removals can take 1-4 business days. Please be mindful that you are responsible for the unit(s) while in your possession. Your call/email/text for removal does not relinquish your possession of the unit.

​

5.    Dumpster must be placed on a hard-packed surface. HaHa Dumpsters is not responsible for damage to grass if instructed to place unit on grass.

​

6.    HaHa Dumpsters will not be held responsible for any damage to pavement or any other road surface material, lawns, fences, shrubbery, septic system, private well, mail boxes, or any other form of property damage during pickup or drop off of dumpster.

​

7.    HaHa Dumpsters does not allow customers to hire any form of 3rd party services such as but not limited to Smash My Trash. If customer still chooses to do so they will be held fully responsible for any and all damages caused to dumpster.

​

8.)   Cleaning due to loading of restricted or hazardous materials may be billed at a 3rd party rate plus a reasonable markup.
